THE JUDGMENT This judgment (in German) is from a magistrates’ court and has no binding effect, but other courts may quote it if they wish to decide similarly. As far as we know the defendant has appealed the verdict, so the District Court will have to decide. The prosecution was brought under section 130, paragraph 1, of the German Criminal Code (in English): “Whosoever, in a manner capable of disturbing the public peace … incites hatred against segments of the population or calls for violent or arbitrary measures against them … shall be liable to imprisonment from three months to five years.”
